Use of the site

Eligibility

By accessing or using play55club.com (the "Site"), you confirm that you are at least 18 years of age, legally competent to enter into binding agreements, and that your use of the Site complies with all applicable laws in your jurisdiction, including those of India.

Permitted use

You may access and use the Site solely for lawful, personal, non-commercial purposes. You agree not to disable, damage, or overburden the Site's functionality; attempt to gain unauthorised access to its servers or connected systems; introduce malware or harmful code; scrape or harvest data without prior written consent; use automated bots or scripts; or impersonate any person or entity.

Account responsibilities

If you create an account on the Site, you are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately if you suspect any unauthorised use. 55 Club will not be liable for any loss arising from your failure to safeguard your credentials.

Modifications and termination

55 Club reserves the right to modify, suspend, or discontinue any feature or the entire Site at any time, with or without notice. We may also terminate or restrict your access if we reasonably believe you have violated these Terms or any applicable law.

Intellectual property

Ownership

All content on the Site, including text, graphics, logos, icons, images, audio and video clips, data compilations, and software, is the exclusive property of 55 Club or its licensors and is protected under applicable Indian and international intellectual property laws, including the Copyright Act, 1957 and the Trade Marks Act, 1999.

Limited licence

55 Club grants you a limited, non-exclusive, non-transferable, revocable licence to access and view Site content for personal, non-commercial use only. This licence does not permit you to reproduce, distribute, publicly display, or create derivative works from any Site content, nor to remove or alter any copyright, trademark, or other proprietary notices appearing on the Site.

Trademarks and user content

The name "55 Club," its logo, and all related marks are trademarks of 55 Club and may not be used without our prior written permission. If you submit or post any content to the Site, you grant 55 Club a worldwide, royalty-free, perpetual licence to use, reproduce, adapt, and distribute that content in any media, and you warrant that doing so does not infringe any third-party rights.

Limitation of liability

Disclaimer of warranties

The Site and all content, features, and services made available through it are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, 55 Club expressly disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Limitation of damages

To the maximum extent permitted by applicable law, 55 Club, its directors, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of or inability to use the Site, regardless of the legal theory on which the claim is based and even if 55 Club has been advised of the possibility of such damages.

Aggregate liability cap and indemnification

Where liability cannot be fully excluded under applicable law, 55 Club's total aggregate liability to you shall not exceed the greater of (a) the amount you paid to 55 Club in the six months preceding the claim, or (b) INR 500. You agree to indemnify and hold harmless 55 Club and its officers, employees, and agents from any claims, damages, and expenses, including reasonable legal fees, arising from your violation of these Terms or your use of the Site.

Governing law

Applicable law and jurisdiction

These Terms of Service and any dispute or claim arising out of or in connection with them, whether contractual, tortious, or otherwise, shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-law provisions. You irrevocably submit to the exclusive jurisdiction of the courts located in India for the resolution of any such dispute.

Dispute resolution

Before initiating any formal legal proceedings, you agree to first contact 55 Club and attempt to resolve the dispute informally by giving at least 30 days' written notice describing the nature and basis of your claim. If the dispute cannot be resolved informally within that period, either party may pursue available remedies under applicable Indian law. Nothing in this clause limits 55 Club's right to seek injunctive or other equitable relief in any competent court to prevent actual or threatened infringement of its intellectual property rights.
